Per Ohio Secretary of State Directive 2024-21, the only individual who may use the Drop Box (or Ballot Collection site) to return a voted ballot is the voter. All individuals who are delivering ballots for a family member (as defined by Ohio Revised Code 3509.05) or disabled voter may either mail the ballot or return the ballot(s) to a Board Official and complete an attestation form (SOS Form 12-P). The attestation can be printed out and completed ahead of time, or Forms will be available at the Ballot Collection site. Ballots of family members or a disabled voter, with an accompanying attestation form, may be accepted at the Ballot Collection Site.
If an individual refuses to sign the attestation form when returning another person's ballot, the board of elections must accept the ballot, but the person returning it should be advised that signing the attestation form is in their best interest, as it ensures they’re complying with the law. Signing the form is an acknowledgement that the person has the legal authority to assist another voter under Section 208 of the federal Voting Rights Act or Section 3509.05 of the Ohio Revised Code. The individual should be reminded that Ohio law prohibits the unauthorized return of another voter’s ballot, and the lack of a signed attestation could subject the individual to further questions about their compliance with the law.
